a decade since they evaluated any vehicle this poorly. yet another black eye for toyota. >> that's right. >> it, of course, is the parent company. >> this is a rare and very direct warning for buyers and owners of the lexus gx 460. about 5,000 cars have been sold. consumer reports says do not buy this car. they found significant and severe rollover risk during turns. they do all of these controlled testings, four different drivers found the same problem. they got another vehicle, found the same problem on this one. they say it is not isolated. it is a problem with the electronic stability control system. it manages the brakes and the steering together. so if you're going up an off ramp and there is some sort of an obstacle, you turn quickly, there could be a real rollover risk for people with this car. if you have this car, they say be very careful on any on ramps or off ramps because they're very concerned about the stability of the vehicle in those circumstances. take it to your toyota dealer and demand a fix. if you don't own this car and thinking about it, consumer reports in a very

toyota. a record $16.4 million penalty for the automaker's alleged failure to quickly tell regulators about gad pedal problems. phil lebeau covers the car industry for us. seems like regulators are sending a message to toyota with this fine they are looking to pursue. >> yeah, this is the way the federal government is saying to toyota, you know what? we're not happy with the way this thing played out over last six months, specifically the handling of the recall notices and the sfiky gad psticky gad p. in fact, documents show they knew about it on september 29th but there wasn't a recall in the united states until january 21st. federal law says you must notify the national highway traffic safety administration within five days of knowledge of a defect. toyota went several months before announcing the defect. remember, february 1st is when they said this is the fix for these sticky gas pd edals. $16.4 million, that's the fine. the largest possible fine that they can put against toyota and that's what it is coming from nhtsa to toyota in the case of this recall issue. >> phil lebeau, tha

in from the associatedded press and news core, our wire service. toyota is about to get slapped with a big fine. toyota motors is accused by the transportation secretary ray lahood of knowingly hiding a dangerous defect for months, not taking action to protect the public and the united states government is seeking a fine against toyota for 16 -- let's see, $16.4 million. the accusation is that toyota hid this sticking pedal defect. they knew about it and hid it for months and as a result they should pay a fine. this is from the transportation secretary ray lahood. we've spoke spoken to our and drew napolitano and he says this is a small fine considering the damage caused. 2.3 million vehicles recalled and accusation people decide as a result but nothing has been found yet. the judge says they should pay it right away because it's a small fine and if they don't, the united states government will sue them to demand they pay $16.4 million, toyota motor company to the united states government as fine for not telling folks about the sticky pedals. >> the butler bulldogs in indiana tips off agai

is over. we need to come clean. that's what herb miller, toyota's then group vice president told his colleagues in an e-mail referring to the safety problems just five days before toyota announced the recall. phil lebeau joins us now. what's toyota's response? >> they are not specifically commenting about the e-mail, but they say they understand they've done a poor job of communicating. this is a copy of it. one of 70,000 document that is the federal government has been going over in looking at how toyota handled the recall for sticky gas pedals. it's clear that some toyota executives realized they had to come out and say something. although it was sent five days before the recall. one of the quotes in this -- then saying they need to work out a resolution with the national highway safety administration. as interesting as the wording is here, lawyers who have sued the company and are planning on taking the company to court, almost all say the same thing. which is great for the public fodder. not sure how much this is going to help their cases in course aside from the fact it's one mo

that is not such good news is we're in the middle of a war right now. toyota set off the war a month ago because they had to get their numbers back. now everybody had to pile in and the big question here is whether they're pulling ahead sales that won't be there too month from now or getting loyal buyers to come in and spend some money. >> what do you make of that alex merkel? they may be pulling buyers forward and selling the deal, not the car. >> there's probably some buyers that are being pulled forward but at this time last year incentives like these would have fallen on deaf ears. what we're seeing right now and what i believe is we're seeing a turn in the auto industry that is sustainable. we'll see job numbers and we're going to see, we have stabilization in the labor markets and the job numbers are going to look really good tomorrow and as we see stabilization in the labor markets, that is the inflection point. that is where the auto sales start to make their turn. ford has not jumped into the incentive band wagon and still had a 34% increase in sales. so, very good numbers. >> in north
